End User license agreement (eula)

This End User License Agreement (“Agreement”) is a legal agreement between you (“User” or “You”) and In the App, Management Solutions LLC, a single-member LLC based in Kentucky (“Company,” “we,” or “us”), that governs your use of our mobile applications and associated services (collectively, the “App”).
By downloading, installing, or using the App, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not download, install, or use the App.
1. License Grant
The Company grants you a limited, non-exclusive, non-transferable, and revocable license to use the App solely for your internal business purposes, in accordance with the terms of this Agreement.
2. Scope of License
The App may only be used on compatible devices that you own or control.
This license does not allow you to distribute, modify, or create derivative works based on the App, unless permitted in writing by the Company.
You may not reverse engineer, decompile, or disassemble any part of the App, except as expressly permitted by applicable law.
3. Third-Party Services
The App may integrate or allow access to third-party services and products provided by Google LLC and its affiliates, including but not limited to Google Gemini. Use of these services is subject to Google’s terms and policies. The Company is not responsible for the content, availability, or practices of these third-party services.
4. User Responsibilities
You are responsible for maintaining the confidentiality of any login information associated with your use of the App.
You agree to use the App in compliance with all applicable local, state, and federal laws and regulations.
5. Data and Privacy
The App may collect and process certain data from users, including personal and usage data, in accordance with the Company’s Privacy Policy. By using the App, you consent to such data collection and processing.
6. Intellectual Property
The App, including its content, features, and functionality, is owned by the Company or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws. Nothing in this Agreement grants you ownership of any intellectual property rights, except for media and content your organization provides for the company to include in the App.
7. Google Services
The App’s functionality may include access to or integration with services provided by Google LLC and its affiliates. By using such features, you agree to comply with Google’s applicable terms of service and privacy policies.
8. Restrictions
You may not:
Use the App for any purpose that is illegal or prohibited by this Agreement.
Share, sell, lease, or rent your access to the App.
Introduce viruses, malware, or any other harmful code.
9. Termination
The Company may terminate this Agreement and your access to the App at any time for any reason. Upon termination, you must cease all use of the App and delete all copies from your devices.
10. Disclaimer of Warranties
The App is provided “as is” and “as available” without warranties of any kind, either express or implied. The Company disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, consequential, or punitive damages, or any loss of profits or revenues, arising out of or in connection with your use or inability to use the App.
12. Governing Law
This Agreement is governed by the laws of the State of Kentucky, without regard to its conflict of law principles. Any disputes arising from this Agreement shall be resolved exclusively in the state or federal courts located in Kentucky.
13. Amendments
The Company reserves the right to modify this Agreement at any time. Any changes will be effective immediately upon posting the updated Agreement on the App. Your continued use of the App following the posting of changes constitutes your acceptance of those changes.
